{"id":7764,"date":"2026-01-02T12:21:31","date_gmt":"2026-01-02T12:21:31","guid":{"rendered":"https:\/\/consmanchester.esteri.it\/?p=7764"},"modified":"2026-01-02T12:37:06","modified_gmt":"2026-01-02T12:37:06","slug":"declarations-of-acquisition-of-citizenship-by-legal-benefit-law-amendments","status":"publish","type":"post","link":"https:\/\/consmanchester.esteri.it\/en\/news\/dal_consolato\/2026\/01\/declarations-of-acquisition-of-citizenship-by-legal-benefit-law-amendments\/","title":{"rendered":"Declarations of acquisition of citizenship by legal benefit: amendments to Article 4, paragraph 1-bis, letter b) of Law No. 91 of 5 February 1992."},"content":{"rendered":"<p data-start=\"31\" data-end=\"238\">We inform that the\u00a0<a href=\"https:\/\/documenti.camera.it\/leg19\/pdl\/pdf\/leg.19.pdl.camera.2750.19PDL0175990.pdf\">Budget Law for the year 2026<\/a>\u00a0provides for specific <span style=\"text-decoration: underline;\"><strong>amendments to Article 4, paragraph 1-bis, letter b) of Law No. 91 of 5 February 1992<\/strong><\/span>.<\/p>\n<p data-start=\"240\" data-end=\"794\">In particular, the amendments provide that the\u00a0<strong><span style=\"text-decoration: underline;\">declarations submitted by parents<\/span><\/strong> \u2014 at least one of whom must be an Italian citizen by birth \u2014 <strong>of minors born abroad who do not automatically acquire Italian citizenship<\/strong>, <strong>as<\/strong> <strong>provided for by Article 4, paragraph 1-bis, letter b) of Law No. 91\/1992<\/strong>, <strong>may be submitted <span style=\"text-decoration: underline;\">within three years<\/span><\/strong>\u00a0(instead of within one year) from the birth of the minor or from the later date on which filiation, including adoptive filiation, to an Italian citizen is established. At the same time, such declarations have been made\u00a0<span style=\"text-decoration: underline;\"><strong>free of charge<\/strong><\/span>, therefore no longer subject to the payment of the \u20ac250 fee provided for in Article 9-bis of Law No. 91\/1992.<\/p>\n<p data-start=\"240\" data-end=\"794\"><strong>These amendments enter into force on 1st January 2026<\/strong>, and do not have retroactive effect. For this reason, the waiver of fees will apply only to applications submitted from that date onward, and <span style=\"text-decoration: underline;\">no refund is provided for applications already submitted<\/span>.<\/p>\n<p data-start=\"1058\" data-end=\"1309\">The requirement to pay the fee of \u20ac250 provided for by Article 9-bis of Law No. 91\/1992 remains in force for the declarations referred to in Article 1, paragraph 1-ter, of Decree-Law No. 36\/2025, to be submitted by 31 May of the current year.<\/p>\n<p data-start=\"1311\" data-end=\"1414\" data-is-last-node=\"\" data-is-only-node=\"\">The &#8220;<a href=\"https:\/\/consmanchester.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/citizenship\/\">Citizenship<\/a>&#8221; section of our website will be update as soon as possible, reflecting the changes above.<\/p>\n","protected":false},"excerpt":{"rendered":"We inform that the\u00a0Budget Law for the year 2026\u00a0provides for specific amendments to Article 4, paragraph 1-bis, letter b) of Law No. 91 of 5 February 1992.
