{"id":7360,"date":"2024-01-12T15:27:35","date_gmt":"2024-01-12T15:27:35","guid":{"rendered":"https:\/\/consmanchester.esteri.it\/?page_id=7360"},"modified":"2026-03-23T15:38:14","modified_gmt":"2026-03-23T15:38:14","slug":"citizenship","status":"publish","type":"page","link":"https:\/\/consmanchester.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/citizenship\/","title":{"rendered":"CITIZENSHIP"},"content":{"rendered":"<p style=\"text-align: justify;\">Possession of Italian citizenship is essential in order to:<\/p>\n<ul>\n<li>request a passport or the electronic identity card (CIE);<\/li>\n<li>apply for registration with AIRE (Registry of Italians Residing Abroad);<\/li>\n<li>request a change of name or surname;<\/li>\n<li>participate in political elections and any referendums.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">The subject is governed by <span style=\"color: #ff0000; text-decoration: underline;\"><strong>Law no. 91\/1992<\/strong><\/span> <\/span>which, unlike the previous legislation, emphasizes the importance of individual will in the acquisition and loss of citizenship, and recognizes the right to hold multiple citizenships simultaneously, subject to different provisions established by international agreements. <strong><span style=\"text-decoration: underline;\">On May 23, 2025, the Italian Parliament adopted a new Law, no. 74, which resulted in changes to the legislation on citizenship by descent<\/span><\/strong>. All the relevant changes and information are outlined below.<\/p>\n<p>&nbsp;<\/p>\n<p>The general principles that guide Italian citizenship are:<\/p>\n<ul>\n<li>transmission of citizenship by descent (<em>ius sanguinis<\/em>) for persons born in Italy;<\/li>\n<li>transmission of citizenship by descent (<em>ius sanguinis<\/em>) for persons born abroad, but only under certain conditions (see the dedicated page), effective from March 28, 2025 following Law no. 74\/2025;<\/li>\n<li>acquisition by <em>ius soli<\/em> (right of the land for birth on Italian territory, only in exceptional cases);<\/li>\n<li>the possibility of holding multiple citizenships;<\/li>\n<li>the expression of personal will for acquisition and loss.<\/li>\n<\/ul>\n<div class=\"accordion-item\" style=\"text-align: justify;\">\n<h2 id=\"heading2\" class=\"accordion-header\"><button class=\"accordion-button\" type=\"button\" data-bs-toggle=\"collapse\" data-bs-target=\"#collapse2\" aria-expanded=\"false\" aria-controls=\"collapse2\"><br \/>\n<strong> RECOGNITION BY DESCENT &#8211; IURE SANGUINIS <\/strong><br \/>\n<\/button><\/h2>\n<div id=\"collapse2\" class=\"accordion-collapse collapse \" role=\"region\" data-bs-parent=\"collapseDiv1\" aria-labelledby=\"heading2\">\n<div class=\"collapse-body p-2\">\n<p><span style=\"color: #ff0000;\"><strong>IURE SANGUINIS (Citizenship by descent)<\/strong><\/span><\/p>\n<p><strong>UNDER 18 years old<\/strong><\/p>\n<p>The transmission of Italian citizenship by descent is possible under the conditions of article 3-bis, Law 91\/92. Check if the conditions apply on here: <a href=\"https:\/\/consmanchester.esteri.it\/it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/atti-di-nascita\/\">Nascita \u2013 Consolato d&#8217;Italia a Manchester<\/a><\/p>\n<p>If transmission by descent is not possible ex art 3-bis, Law 91\/92, you can verify whether the conditions for <strong><u>ACQUISITION OF CITIZENSHIP \u201cPER BENEFICIO DI LEGGE\u201d<\/u> <\/strong>\u00a0apply.<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>OVER 18 years old<\/strong><\/span><\/p>\n<p>Foreign citizens with Italian ancestry can apply to have their Italian citizenship recognized by descent.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ul>\n<li><span style=\"color: #ff0000;\"><strong>REQUIRED ELEMENTS<\/strong><\/span><\/li>\n<\/ul>\n<p>The required process of reconstruction of the succession line can often be complex. It is the applicant\u2019s responsibility to recognize, depending on the circumstances, whether they can request the recognition and therefore present the application.<\/p>\n<p>Applications must be presented to the Embassy\/Consulate responsible for the area of residence; if living in Italy, directly to the relevant Comune.<\/p>\n<p><strong>The recognition of Italian citizenship by descent is exclusively possible according to article 3-bis of Law 91\/1992, as modified by Law 74\/2025<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p>Specifically:<\/p>\n<p><strong>Letter C: <em>\u201can ancestor of first\/second degree holds or held at the time of the death exclusively the Italian Citizenship\u201d<\/em><\/strong><\/p>\n<p><strong>Letter D: <em>\u201ca parent or adoptive parent resided in Italy for at least 2 years following the date of acquisition of Italian citizenship and before the birth of the son\/daughter\u201d<\/em><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Before applying, it is fundamental to consider that:<\/p>\n<ol>\n<li>If the ancestor acquired a foreign citizenship before 1992 or if any of the ancestors ever renounced their Italian citizenship, the line of transmission by descent is interrupted. The ancestor and their kids under 18 have lost the right to Italian citizenship (artt. 7, 8, 12 L. 555\/1912, Circolare Ministero dell\u2019Interno n. 43347, 03\/10\/2024). The only exceptions exist if the ancestor reacquired Italian citizenship when their kids were still under 18 or if their kids reacquired Italian citizenship at 19 years old.<\/li>\n<li>It is possible to apply through the maternal line only if the descendant was born on\/after 01\/01\/1948.<\/li>\n<\/ol>\n<p><strong>Family members of applicants who have formerly applied for recognition of citizenship may share the original documents referred to common ancestors and only present copies of them when applying<\/strong>. <strong>When doing so, it is kindly requested to specify that to the consular officer receiving the application.<\/strong><\/p>\n<p><strong><u>Consulates cannot offer assistance in retrieving documents for the application from Italian archives. It is the applicant\u2019s responsibility to obtain all the documents required<\/u><\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Time and costs<\/strong><\/span><\/p>\n<p>All the original documents must be brought to the Consulate on the day of the appointment. <strong>The application costs \u20ac600<\/strong> (according to article 7 TC, Decreto legislativo 72\/11) <strong>and it is only payable by debit card at the appointment<\/strong>. <strong>The payment is non-refundable and it does not depend on the outcome of the application<\/strong>. <strong><u>Applications are processed between 24\/36 months from the application date<\/u><\/strong>. Applications that are not complete will be returned according to art 10-bis, Law 241\/90.<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>How to book an appointment <\/strong><\/span><\/p>\n<p><strong><u>Appointments are exclusively booked through Prenotami<\/u><\/strong>. We kindly invite you to be aware of individuals offering earlier appointments in exchange for payments.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"color: #ff0000;\"><strong>DOCUMENTS REQUIRED FOR AN APPLICATION PURSUANT TO LETTER C, Article 3-bis of Law 91\/1992<\/strong><\/span><\/li>\n<\/ul>\n<p><strong><em>\u201ca first- or second-degree ascendant holds, or held at the time of death, exclusively Italian citizenship\u201d<\/em><\/strong><\/p>\n<p><strong>FOR THE APPLICANT<\/strong><\/p>\n<ul>\n<li><strong>Valid passport of the applicant<\/strong> and a photocopy of the page showing photo and signature.<br \/>\nIf the applicant holds multiple citizenships, all other passports must be presented in original, together with certificates of naturalization for any other citizenships acquired, duly apostilled\/legalized and professionally translated into Italian;<\/li>\n<li><strong>Proof of residence within this consular district<\/strong> (e.g. utility bills, Council Tax, Moldova, Montenegro, the Netherlands, Poland, Portugal, Romania, Serbia, Slovenia, Spain, Switzerland or Turkey<\/strong> \u2192 <em>pluringual birth certificate<\/em>, in original (pursuant to the Vienna Convention of 1976);<\/li>\n<li><strong>if the applicant was born in a Member State of the European Union<\/strong> \u2192 birth certificate with multilingual standard form pursuant to Regulation (EU) 2016\/1191;<\/li>\n<li><strong>if the applicant was born in another Country<\/strong> \u2192 please refer to the type of certificate and the legalization and translation requirements indicated by the diplomatic-consular office competent for the place of birth;<\/li>\n<\/ul>\n<\/li>\n<li><strong>Civil status records<\/strong> (e.g. marriage, divorce, second marriage):<br \/>\neach certificate must be submitted in original, <a href=\"https:\/\/consmanchester.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/albo-consolare\/legalizzazioni-apostille-e-traduzioni\/\">apostilled\/legalized and professionally translated into Italian.<\/a><br \/>\nFor each marriage and each divorce, a simple copy of the passport and birth certificate of the current and\/or former spouse\/partner must also be provided.<br \/>\n(For UK divorces, see the specific paragraph at the end of this section);<\/li>\n<li>If the <strong>ancestor in question is the applicant\u2019s parent<\/strong> and such ancestor had not acquired British citizenship at the time of the birth of the minor children, the applicant may submit the <strong>birth certificates of minor children<\/strong>, in original, <a href=\"https:\/\/consmanchester.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/albo-consolare\/legalizzazioni-apostille-e-traduzioni\/\">apostilled\/legalized and professionally translated into Italian.<\/a><\/li>\n<\/ul>\n<p><strong>REGARDING THE ANCESTOR (parent or grandparent), an Italian citizen who emigrated abroad<\/strong><\/p>\n<ul>\n<li><strong>\u201cEstratto per riassunto dell\u2019atto di nascita\u201d<\/strong> or <strong>\u201ccopia conforme dell\u2019atto di nascita\u201d<\/strong><br \/>\nIt must include the names of the parents and any marginal annotations (e.g. marriage, possible divorce, loss and\/or reacquisition of Italian citizenship, death).<br \/>\nThe document must be in original, signed and stamped by the Italian Civil Status Registrar.<br \/>\nIf the ancestor was born before the establishment of the Civil Status Register in the Comune of birth, a <strong>baptism certificate<\/strong>, in original, signed and stamped by the parish office, must be provided, together with a letter from the municipality certifying the year of establishment of the Civil Status Register and the absence of the individual\u2019s record therein;<\/li>\n<li><strong>Civil status records<\/strong> (marriage, possible divorce or death of spouse, possible second marriage).<br \/>\nEach certificate must be submitted in original, apostilled\/legalized and professionally translated into Italian.<br \/>\nIf these records have already been registered in Italy, <strong>\u201cestratto per riassunto dell\u2019atto\u201d<\/strong> issued by the competent municipality must also be provided.<br \/>\n<strong>No discrepancies of any kind (names, surnames, places, dates, etc.) are permitted in the documentation. <\/strong><strong>Any errors must be corrected before submission<\/strong>;<\/li>\n<li>If the ancestor <strong>emigrated to the United Kingdom<\/strong>:\n<ul>\n<li>certificate of non-naturalization issued by the <a href=\"https:\/\/www.gov.uk\/government\/publications\/apply-for-proof-that-you-do-not-have-british-citizenship-form-nq\"><strong>Home Office \u2013 UK Border Agency<\/strong><\/a> (<a href=\"mailto:ukbanationalityenquiries@ukba.gsi.gov.uk\">ukbanationalityenquiries@ukba.gsi.gov.uk<\/a>).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>The certificate must be <a href=\"https:\/\/consmanchester.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/albo-consolare\/legalizzazioni-apostille-e-traduzioni\/\">apostilled and professionally translated into Italian<\/a>.<br \/>\nThe apostille must legalize the signature of the official who issued the declaration.<\/p>\n<ul>\n<li>If the ancestor <strong>emigrated to or resided in other Countries<\/strong>:\n<ul>\n<li>declaration of non-naturalization issued by the competent authorities of the relevant Country, exclusively in original, <a href=\"https:\/\/consmanchester.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/albo-consolare\/legalizzazioni-apostille-e-traduzioni\/\">duly apostilled or legalized by the competent authorities and professionally translated into Italian<\/a> (the translation may also require apostille\/legalization or a declaration of conformity).<br \/>\nApplicants are advised to verify the requirements on the website of the Italian Embassy or Consulate in the Country of issuance.<br \/>\nIf the ancestor resided in multiple countries (e.g. Argentina, Brazil, Venezuela), non-naturalization certificates must be produced for each Country.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>IMPORTANT:<\/strong> if other documents show that the ancestor used different identities (e.g. \u201cGiuseppe DE SANTIS\u201d on the birth certificate and \u201cGuiseppe DE SANTIS\u201d or \u201cGiuseppe Angelo DESANTIS\u201d on marriage or children\u2019s birth certificates), the declaration must include <strong>all such identities<\/strong>. Otherwise, new certificates must be obtained;<\/p>\n<ul>\n<li>Any other documents useful for reconstruction of the lineage: passports, identity documents, immigration records, visas, residence permits, family status certificates, etc.<\/li>\n<\/ul>\n<p><strong>REGARDING ANY INTERMEDIATE ASCENDANTS IN THE DIRECT LINE<\/strong><\/p>\n<ul>\n<li><strong>Civil status records<\/strong>: birth, marriage, possible divorce or death of spouse, possible second marriage, death of all direct-line ascendants.<br \/>\nIf the parents were not married at the time of birth, the birth certificate must list both parents as informants.<br \/>\nIf the parents were married at the time of birth, the name of one informant is sufficient.<br \/>\nEach certificate must be submitted in <a href=\"https:\/\/consmanchester.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/albo-consolare\/legalizzazioni-apostille-e-traduzioni\/\">original, apostilled\/legalized and professionally translated<\/a> into Italian.<br \/>\nIf these records have already been registered in Italy, <strong>summary extracts<\/strong> issued by the competent municipality must also be provided.<br \/>\n<strong>No discrepancies of any kind are permitted; any errors must be corrected before submission<\/strong>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"color: Comune;<\/li>\n<li><strong>Photocopy of an Italian passport or identity document<\/strong> of the Italian parent;<\/li>\n<li>If the applicant is not British, a <strong>share code<\/strong> proving the right to live in the United Kingdom;<\/li>\n<li><strong>Special Delivery envelope<\/strong> for the possible return of documents, pre-addressed and prepaid up to 100 grams.<\/li>\n<\/ul>\n<p>Additionally:<\/p>\n<ul>\n<li>If the parents married or entered into a civil partnership abroad and the relevant record has not yet been registered in Italy, the <strong>registration of the marriage or civil partnership<\/strong> must be requested simultaneously.<\/li>\n<li>If the parents are <strong>not married nor in a civil partnership<\/strong>, both must appear as informants on the birth certificate.<br \/>\nOtherwise, they must carry out a <strong>recognition of parentage of a child born out of wedlock<\/strong> (pursuant to Articles 250 et seq. of Presidential Decree 396\/2000) before a notary.<br \/>\nThe original recognition deed must be submitted to the Consulate (if executed before a UK notary, it must be <a href=\"https:\/\/consmanchester.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/albo-consolare\/legalizzazioni-apostille-e-traduzioni\/\">apostilled and translated into Italian<\/a>).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"accordion-item\" style=\"text-align: justify;\">\n<h2 id=\"heading4\" class=\"accordion-header\"><button class=\"accordion-button\" type=\"button\" data-bs-toggle=\"collapse\" data-bs-target=\"#collapse4\" aria-expanded=\"false\" aria-controls=\"collapse4\"><br \/>\n<b> Renounciation of citizenship <\/b><\/button><\/h2>\n<div id=\"collapse4\" class=\"accordion-collapse collapse \" role=\"region\" data-bs-parent=\"collapseDiv1\" aria-labelledby=\"heading4\">\n<div class=\"collapse-body p-4\">\n<p>Citizens residing within the consular jurisdiction of the Consulate of Italy in <strong>Manchester<\/strong> may renounce their citizenship by <strong>appointment only<\/strong>, during which they must present the following <strong>original documents<\/strong>:<\/p>\n<ul>\n<li><strong>Birth certificate extract<\/strong> (\u201cestratto per riassunto dell\u2019atto di nascita\u201d) issued by the Italian municipality where the birth was registered or transcribed;<\/li>\n<li><strong>Proof of residence<\/strong> within this consular district (e.g. utility bills, Council Tax, etc.);<\/li>\n<li><strong>Foreign passport or other ID<\/strong> proving possession of a second citizenship;<\/li>\n<li><strong>Any Italian passport or identity card<\/strong> (these will be cancelled);<\/li>\n<li>For those <strong>born outside the UK<\/strong>, a <strong>British naturalization certificate<\/strong>, issued by the <strong>National Archives<\/strong> or the <strong>Home Office<\/strong>, apostilled and translated into Italian.<br \/>\nApplicants wishing to <strong>retain the original<\/strong> naturalization certificate must instead submit a <strong>certified copy<\/strong> (certified by a <strong>Notary Public<\/strong> whose signature must be apostilled) and the document must be translated into Italian;<\/li>\n<li><strong>Receipt of a \u20ac250 bank transfer<\/strong>, made with the following details:\n<ul>\n<li><strong>IBAN<\/strong>: IT54D0760103200000000809020<\/li>\n<li><strong>Receiving Cittadinanza<\/li>\n<li><strong>Payment reference<\/strong>: applicant\u2019s full name + <em>&#8220;rinuncia alla cittadinanza&#8221;<\/em><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>To <span style=\"text-decoration: underline;\"><strong>book an appointment<\/strong><\/span>, the applicant must <strong>send an email to<\/strong> <a href=\"mailto:manchester.cittadinanza@esteri.it\"><span style=\"text-decoration: underline;\">manchester.cittadinanza@esteri.it<\/span><\/a>, with the subject line:<br \/>\n<strong>&#8220;RICHIESTA RINUNCIA CITTADINANZA \u2013 [applicant\u2019s full name]&#8221; <\/strong>and attach <strong>scanned copies<\/strong> of all the required documents listed above.<\/p>\n<p>On the day of the appointment, <strong>administrative fees<\/strong> (Art. 4b) must also be paid using a <strong>British debit card<\/strong>.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"accordion-item\" style=\"text-align: justify;\">\n<h2 id=\"heading5\" class=\"accordion-header\"><button class=\"accordion-button\" type=\"button\" data-bs-toggle=\"collapse\" data-bs-target=\"#collapse5\" aria-expanded=\"false\" aria-controls=\"collapse5\"><br \/>\n<strong>Reacquisition of citizenship<\/strong><br \/>\n<\/button><\/h2>\n<div id=\"collapse5\" class=\"accordion-collapse collapse \" role=\"region\" data-bs-parent=\"collapseDiv1\" aria-labelledby=\"heading5\">\n<div class=\"collapse-body p-5\">\n<p>Individuals who voluntarily acquired another citizenship for any reason <strong>before August 15, 1992<\/strong>, automatically <strong>lost their Italian citizenship<\/strong>.<\/p>\n<p><strong>Law no. 74 of May 23, 2025<\/strong> has reopened the possibility of reacquiring citizenship for former Italian citizens who:<\/p>\n<ul>\n<li>Were <strong>born in Italy<\/strong>, or;<\/li>\n<li><strong>Resided in Italy<\/strong> for at least two consecutive years, and;<\/li>\n<li>Lost their Italian citizenship <strong>no later than August 15, 1992<\/strong> under Article 8, paragraphs 1 and 2, or Article 12 of <strong>Law no. 555 of 1912<\/strong> (&#8220;naturalization in a foreign country, renunciation following involuntary acquisition of a foreign citizenship, or minor children living with a parent who lost citizenship&#8221;).<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">This reacquisition <strong>does not apply<\/strong> to those who renounced Italian citizenship (or lost it for any other reason) <strong>on or after August 16, 1992<\/strong><\/span>.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">IMPORTANT<\/span>: Applications for reacquisition may be submitted from July 1, 2025, to December 31, 2027.<\/strong><\/p>\n<p><strong>Required Documents<\/strong><\/p>\n<p>Applicants must submit:<\/p>\n<ul>\n<li>A <strong>valid identity document<\/strong> issued by the authorities of their current Country of citizenship;<\/li>\n<li>A <strong>birth certificate<\/strong>: if born abroad, it must be legalized, translated, and suitable for registration in Italy;<\/li>\n<li>For those born abroad, a <strong>residence history certificate<\/strong> issued by the relevant Italian municipality;<\/li>\n<li>A <strong>historical citizenship certificate<\/strong>;<\/li>\n<li><strong>Proof of the cause and date<\/strong> of citizenship loss (e.g. certificate of naturalization or, where applicable, a birth certificate accompanied by a certificate of citizenship and the title under which it was acquired). Foreign-issued documents must be <strong>properly legalized and translated<\/strong> into Italian.<\/li>\n<\/ul>\n<p>A <strong>\u20ac250 fee<\/strong> must be paid at the <strong>Consular Office<\/strong> when submitting the declaration.<\/p>\n<p>The <strong>declaration must be made in person<\/strong> by the applicant.<\/p>\n<p>According to <strong>Article 15 of Law no. 91\/1992<\/strong>, reacquisition takes effect <strong>the day after<\/strong> the declaration is made \u2014 <strong>not retroactively from birth<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Special Case: Women Who Married British Citizens<\/strong><\/p>\n<p>Italian women who <strong>married British citizens before December 31, 1948<\/strong> automatically acquired British citizenship and, under the laws in force at that time, <strong>automatically lost their Italian citizenship<\/strong>. These women may reacquire Italian citizenship by making a formal declaration at the <strong>Consulate<\/strong>.<\/p>\n<p>Their <strong>children<\/strong> are eligible for <strong>recognition of Italian citizenship<\/strong>, provided they were <strong>born on or after January 1, 1948<\/strong>.<\/p>\n<p>By contrast, Italian women who married British citizens <strong>from January 1, 1949 onwards<\/strong> did <strong>not<\/strong> automatically acquire British citizenship (<strong>British Nationality Act 1948<\/strong>).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>How to Book an Appointment<\/strong><\/p>\n<p>To <strong>request an appointment<\/strong>, applicants must <strong>send an email to<\/strong> <a href=\"mailto:manchester.cittadinanza@esteri.it\"><span style=\"text-decoration: underline;\">manchester.cittadinanza@esteri.it<\/span><\/a>, with the subject line:<br \/>\n<strong>\u201cRICHIESTA RIACQUISTO CITTADINANZA \u2013 [applicant\u2019s full name]\u201d <\/strong>and attach <strong>scanned copies<\/strong> of all the required documents listed above.<\/p>\n<div class=\"collapse-body p-5\"><\/div>\n<\/div>\n<\/div>\n<div class=\"accordion-item\" style=\"text-align: justify;\">\n<h2 id=\"heading6\" class=\"accordion-header\"><button class=\"accordion-button\" type=\"button\" data-bs-toggle=\"collapse\" data-bs-target=\"#collapse6\" aria-expanded=\"false\" aria-controls=\"collapse6\"><br \/>\n<strong>Acquisition of citizenship &#8220;PER BENEFICIO DI LEGGE&#8221;<\/strong><br \/>\n<\/button><\/h2>\n<div id=\"collapse6\" class=\"accordion-collapse collapse \" role=\"region\" data-bs-parent=\"collapseDiv1\" aria-labelledby=\"heading6\">\n<div class=\"collapse-body p-6\">\n<p>In two specific cases, outlined in <strong>Article 4(1-bis)<\/strong> of <em>Law no. 91\/1992 <\/em>and <strong>Article 1(1-ter)<\/strong> of Decree-Law no. 36\/2025, <strong>minor children born abroad<\/strong> <strong>who are not elegible to be Italian citizens by birth,\u00a0may acquire Italian citizenship<\/strong>.<\/p>\n<p>According to Article 15 of <em>Law no. 91\/1992<\/em>, the child <strong>does not acquire citizenship from birth<\/strong>, but from the day <strong>after<\/strong> all the legal conditions are fulfilled.<\/p>\n<p><strong>1) First Case \u2013 Article 4(1-bis) of <\/strong><em>Law no. 91\/1992<\/em><\/p>\n<p>The following conditions must be met <strong>jointly<\/strong>:<\/p>\n<ul>\n<li>One of the parents is an Italian citizen <strong>by birth<\/strong>. Citizens who acquired Italian citizenship <strong>by naturalization<\/strong> (Art. 9), <strong>by operation of law<\/strong> (Art. 4), <strong>by marriage<\/strong> (Art. 5 or Art. 10 of Legge no. 555\/1912), <strong>by reacquisition<\/strong> (Art. 13 or 17), or by <strong>iuris communicatio<\/strong> (Art. 14), are <span style=\"text-decoration: underline;\">excluded<\/span>.<\/li>\n<li>Both parents (including the non-Italian parent) or the legal guardian must <strong>submit a declaration of intent<\/strong> to acquire citizenship <strong>within THREE years<\/strong> from:\n<ul>\n<li>the child\u2019s birth, or;<\/li>\n<li>the date when filiation from the Italian citizen parent is established, or;<\/li>\n<li>the date of adoption by the Italian citizen (while the child is still a minor).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>If both parents are Italian citizens by birth but filiation is recognized at different times, the three-years period starts from the <strong>first recognition<\/strong>, as that already conveys citizenship.<br \/>\nIf the <strong>foreign or non-native Italian citizen<\/strong> parent recognizes the child first, the three-years period starts from the recognition by the <strong>second parent<\/strong>, who is an Italian citizen by birth.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>2) Second Case \u2013 Article 1(1-ter) of Decree-Law no. 36\/2025<\/strong><\/p>\n<p>This applies when <strong>all<\/strong> the following conditions are met:<\/p>\n<ul>\n<li>The individual was <strong>a minor on May 24, 2025<\/strong> (i.e. had not yet turned 18);<\/li>\n<li>The individual is the <strong>child of a citizen by birth<\/strong> who meets the conditions in <strong>letters a), a-bis), and b)<\/strong> of Article 3-bis of Law no. 91\/1992.<br \/>\nIn other words, the parents must have been recognized as Italian citizens through:<\/p>\n<ul>\n<li>a citizenship application (administrative or judicial) submitted <strong>before 11:59 PM (Rome time) on March 27, 2025<\/strong>, or;<\/li>\n<li>an appointment confirmed by a Consulate or Municipality by that same date.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span In caso contrario, dovr\u00e0 essere fornita da entrambi i coniugi documentazione comprovante la motivazione (es. lavoro, scolarit\u00e0 dei figli, cure mediche o altro), che determina o ha determinato la necessit\u00e0 del domicilio disgiunto.<\/li>\n<\/ol>\n<ul>\n<li><u>Termini di presentazione<\/u>:<\/li>\n<\/ul>\n<ol>\n<li>La domanda pu\u00f2 essere presentata tre anni dopo la celebrazione del matrimonio\/unione civile, se il coniuge \u00e8 cittadino italiano\u00a0<em>iure sanguinis,\u00a0<\/em>cio\u00e8 dalla nascita. Se il coniuge italiano ha acquisito la cittadinanza successivamente al matrimonio (ad es. per residenza in Italia), i tre anni decorrono dalla data della naturalizzazione del coniuge. Al fine del conferimento della cittadinanza italiana, alla data di adozione del decreto non deve essere intervenuto lo scioglimento del matrimonio\/unione civile per separazione personale o divorzio. Il certificato da richiedere per il Regno Unito \u00e8 il ACRO Police certificate, debitamente apostillato e tradotto.\u00a0<\/strong>Il richiedente \u00e8 esonerato dal presentare il certificato penale del Paese di origine solo se lo ha lasciato prima del compimento dei 14 anni e\u00a0<u>non<\/u>\u00a0ne ha conservato la cittadinanza.<\/li>\n<li>Ricevuta del versamento del c<strong>ontributo di 250\u20ac<\/strong>\u00a0a favore del Ministero dell\u2019Interno, con le modalit\u00e0 indicate nella sezione \u201cCosti\u201d.<\/li>\n<li><strong>Documento di identit\u00e0<\/strong>: fotocopia del passaporto oppure della carta di identit\u00e0 estera in corso di validit\u00e0 (pagine con i dati personali, fotografia, date di rilascio e scadenza).<\/li>\n<li><strong>Copia dell\u2019atto di matrimonio<\/strong>\u00a0o estratto per riassunto del registro dei matrimoni, da richiedere al competente Comune italiano in cui l\u2019atto risulta trascritto, possibilmente rilasciato da non oltre sei mesi.<\/li>\n<\/ul>\n<p><u>NOTA BENE<\/u>: Qualora il richiedente sia un cittadino UE, potr\u00e0 avvalersi dell\u2019autocertificazione ai sensi del DPR 445\/2000.<\/p>\n<ul>\n<li><strong>Certificato di conoscenza della lingua italiana<\/strong>\u00a0non inferiore al livello B1 del Quadro Comune Europeo di Riferimento (QCER).\u00a0<u>Le certificazioni ammesse sono esclusivamente le seguenti<\/u>:<\/li>\n<\/ul>\n<ol>\n<li>PLIDA della Societ\u00e0 Dante Alighieri<\/li>\n<li>CertIt dell\u2019Universit\u00e0 Roma Tre<\/li>\n<li>CILS dell\u2019Universit\u00e0 per stranieri di Siena<\/li>\n<li>CELI dell\u2019Universit\u00e0 per stranieri di Perugia<\/li>\n<li>Co.L dell\u2019Universit\u00e0 per stranieri di Reggio Calabria<\/li>\n<\/ol>\n<p>Altre certificazioni provenienti dai suddetti Enti o da altre istituzioni non sono idonee e non potranno essere accettate.<\/p>\n<p>Non sono, invece, tenuti alla presentazione del titolo di conoscenza della lingua italiana:<\/p>\n<ul>\n<li>Gli stranieri (anche se residenti all\u2019estero) che abbiano sottoscritto l\u2019Accordo di integrazione di cui all\u2019art. 4 bis del D.Lgs. n. 286\/1998 Testo Unico Immigrazione.<\/li>\n<li>I titolari di permesso di soggiorno per soggiornanti di lungo periodo UE (o CE) di cui all\u2019articolo 9 del medesimo Testo Unico (anche se residenti all\u2019estero), solo se rilasciato dalle Autorit\u00e0 italiane. I permessi di soggiorno per motivi familiari o quelli emessi da altri Stati non sono idonei.<\/li>\n<li>Coloro che hanno conseguito un titolo di studio emesso da un istituto di istruzione pubblico o paritario riconosciuto dal Ministero dell\u2019Istruzione, dell\u2019Universit\u00e0 e della Ricerca e\/o dal Ministero degli Affari Esteri e della Cooperazione internazionale.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><u>Procedura<\/u><\/strong><\/p>\n<p><strong><em>FASE 1 \u2013\u00a0<\/em><\/strong><strong>REGISTRAZIONE E INSERIMENTO ISTANZA<\/strong><\/p>\n<p>Il richiedente residente all\u2019estero dovr\u00e0 effettuare la registrazione sul portale del Ministero dell\u2019Interno (<u>https:\/\/portaleservizi.dlci.interno.it\/AliCittadinanza\/ali\/home.htm<\/u>) senza l\u2019utilizzo di SPID ma con il proprio indirizzo e-mail.<\/p>\n<p>Si precisa che l\u2019indirizzo e-mail dichiarato sul portale in fase di inoltro della domanda online costituisce domicilio eletto (art. 47 c.c.), si rende pertanto necessaria una frequente consultazione della propria casella di posta elettronica in quanto tutte le comunicazioni relative alla domanda di cittadinanza, ivi comprese richieste di integrazione documentale, convocazioni, notifiche di provvedimenti, ecc. avverranno unicamente tramite canale informatico.<\/p>\n<p><strong>Il richiedente \u00e8 tenuto a registrare i propri dati con la massima attenzione in quanto questi non potranno essere modificati e, in caso di errore, si dovr\u00e0 procedere ad una nuova registrazione con altro indirizzo e-mail.\u00a0<\/strong>In particolare, andranno riportate le generalit\u00e0 indicate nell\u2019atto di nascita (incluse eventuali annotazioni) e\/o in atti e documenti formati all\u2019estero dalle competenti autorit\u00e0 straniere (quali atti di matrimonio, documenti d\u2019identit\u00e0, sentenze di cambio nome\/cognome, etc.).\u00a0<em>In caso di discordanze, il richiedente \u00e8 tenuto a fornire opportuna documentazione giustificativa.<\/em><\/p>\n<p>Nella domanda dovr\u00e0 essere dichiarata l\u2019eventuale convivenza di figli minori del\/della richiedente, nati da una precedente relazione.<\/p>\n<p>Si dovranno dichiarare tutte le residenze dal quattordicesimo anno e non lasciare periodi di tempo non dichiarati.<\/p>\n<p>Non andranno riportati caratteri o segni speciali (per esempio la cediglia, accenti acuti o gravi all\u2019interno della parola, accenti circonflessi, etc.). Sar\u00e0 possibile inserire solo l\u2019accento sull\u2019ultima lettera utilizzando l\u2019apostrofo, qualora ci sia anche nella lingua di origine.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>FASE 2 \u2013\u00a0<\/em><\/strong><strong>VERIFICA CONSOLARE<\/strong><\/p>\n<p>L\u2019Ufficio Consolare sar\u00e0 automaticamente informato della presentazione della domanda e proceder\u00e0 alle necessarie verifiche. Il richiedente ricever\u00e0 quindi, in modalit\u00e0 telematica tramite il portale del Ministero dell\u2019Interno, una comunicazione relativa all\u2019accettazione o al rifiuto della propria pratica.<\/p>\n<p>In caso di rifiuto della domanda, si potr\u00e0 ripresentare la domanda avendo cura di sanare gli errori indicati nel rifiuto stesso e si potranno riutilizzare i pagamenti gi\u00e0 effettuati, se si ripresenta la domanda entro un anno.<\/p>\n<p>In caso di accettazione, il richiedente sar\u00e0 convocato per via telematica presso la Rappresentanza diplomatico-consolare per l\u2019autentica della firma apposta sulla domanda di cittadinanza, per la consegna di tutta la documentazione cartacea in originale, ivi compresa quella gi\u00e0 trasmessa per via telematica tramite il Portale, per la riscossione delle percezioni consolari previste.<\/p>\n<p>Tutta la documentazione di cui sopra sar\u00e0 conservata in originale dalla Rappresentanza diplomatico-consolare, ad eccezione del documento d\u2019identit\u00e0 e del certificato linguistico, per i quali verr\u00e0 effettuata una copia conforme con relativi pagamenti.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>FASE 3 \u2013\u00a0<\/em><\/strong><strong>VALUTAZIONE E TERMINI DEL PROCEDIMENTO<\/strong><\/p>\n<p>La valutazione della domanda e la definizione del procedimento sono di esclusiva competenza del Ministero dell\u2019Interno, entro 24 mesi dalla data di presentazione della domanda, prorogabili fino al massimo di 36 mesi. Qualora al termine della valutazione della pratica il procedimento si concluda positivamente, il Ministero dell\u2019Interno invier\u00e0 il decreto di conferimento della cittadinanza italiana alla Rappresentanza diplomatico-consolare competente per residenza dell\u2019interessato\/a.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>FASE 4 \u2013\u00a0<\/em><\/strong><strong>DECRETO, NOTIFICA E GIURAMENTO<\/strong><\/p>\n<p>Il decreto di conferimento della cittadinanza italiana verr\u00e0 notificato \u2013 tramite portale \u2013 con comunicazione indirizzata al richiedente. All\u2019atto della notifica verranno altres\u00ec richiesti documenti volti a verificare la permanenza del vincolo coniugale, con data successiva al decreto, quali, ad esempio (elenco non esaustivo):<\/p>\n<ul>\n<li>Atto integrale di matrimonio rilasciato dal competente Comune italiano (non l\u2019estratto) e corrispondente atto estero<\/li>\n<li>Certificato penale del Paese di attuale residenza, debitamente legalizzato e tradotto (vedi sezione \u201cDocumenti\u201d)<\/li>\n<\/ul>\n<p>Alla data di adozione del decreto, quindi, non deve essere intervenuto lo scioglimento del matrimonio o dell\u2019unione civile n\u00e9 la separazione personale (sentenza di separazione). Invece, il decesso del coniuge avvenuto dopo la presentazione della domanda di cittadinanza non comporta la decadenza del beneficio.<\/p>\n<p>Entro e non oltre sei mesi dalla notifica, l\u2019interessato verr\u00e0 convocato presso gli uffici consolari, per prestare giuramento di fedelt\u00e0 alla Repubblica e alle sue leggi.
